BYD Factory Construction in Brazil Halted Amid Human Trafficking Allegations

Chinese automaker BYD's construction of a vast factory in Brazil has been temporarily halted due to allegations of human trafficking. As reported by Reuters, Brazilian labor prosecutors have filed a lawsuit against BYD, accusing the company of subjecting workers to "slavery-like conditions."

The lawsuit, filed against BYD and two partner companies, China JinJiang Construction Brazil and Tecmonta Equipamentos Inteligentes Brasil Co., seeks approximately $45 million in damages and additional compensation for each worker affected. The project, initially set to be completed in December 2026, now faces a delay due to these allegations.

The prosecutors' lawsuit alleges that hundreds of Chinese workers were brought to Brazil under irregular circumstances, promised better working conditions, and found themselves working under conditions analogous to modern-day slavery. The labor violations reportedly include breaches of labor rules, with prosecutors seeking fines for each violation multiplied by the number of affected workers.

BYD has expressed its commitment to upholding human rights and respecting international and Brazilian labor laws. The company has also stated its willingness to cooperate with the lawyers involved in the case.

The factory, located in Bahia, Brazil, is a part of BYD's expansion into overseas markets, making Brazil a strategic location for Chinese carmakers. This scenario presents a significant challenge to BYD's reputation and operations in the country. The case is considered well-founded, with substantial evidence, and a settlement via the courts remains a possibility.

  1. What is unclear is whether the human trafficking allegations will adversely impact BYD's expansion into the transportation and automotive industry, particularly in the finance sector, given the company's strategic investment in Brazil.
  2. The lawsuit against BYD, JinJiang Construction Brazil, and Tecmonta in the industry of construction and automotive, not only implicates the company's reputation within Brazil, but also raises concerns about compliance with international and finance-related regulations.
