The UK Gambling Commission (UKGC) is currently facing some uncomfortable questions, and it all began when they linked up with Richard Desmond, the ex-porn baron billionaire, earlier this year. This connection was made due to a dispute over the UKGC awarding the National Lottery contract to Allwyn Entertainment—a move that saw multiple parties filing lawsuits against the UKGC, Desmond being one of them.

Just this week, things have taken a turn for the worse for the UKGC, as their competence is questioned following a blunder involving sensitive documents related to the lawsuit. It seems that the UKGC's lawyers have inadvertently (or perhaps intentionally?) sent over 4,000 sensitive documents pertaining to the lottery lawsuit to Desmond's legal team.

Now, Desmond's legal team is considering using some of these sensitive documents in their £200m ($255m) lottery suit against the UKGC.

Did the mistake happen on purpose?

Desmond's team is hinting that the internal disclosure wasn't an honest mistake. Evidence points to a UKGC source intentionally sending the sensitive documents. Northern & Shell attorney Sa'ad Hossain KC backed up these claims, stating that these documents had been scrutinized by senior lawyers and were legitimate.

"We are entitled to assume the documents have been disclosed to us not by mistake," Hossain argued.

This revelation casts a serious doubt upon the UKGC's competence and transparency.

A problem with closely guarded secrets?

The current predicament facing the UKGC, stemming from Desmond's quarter, is worth scrutinizing. Late last year, whispers emerged that the regulator was engaging in secret meetings with Northern & Shell with the intention of settling the £200m claim.

According to these reports, the UKGC allegedly offered a maximum settlement of £10m ($12.9m), an offer that was swiftly rejected by Desmond. As a result, he now has the national regulator's reputation on the line.

The UKGC's attorney, Tamara Oppenheimer KC, appealed for all parties to exercise restraint and honesty during this week's pre-trial hearing.
