FCC Fines 19 Station Groups $3.3M for Children's Programming Violations

The FCC has issued a Forfeiture Order, fining 19 station groups a total of $3,334,000 for violations of children's programming rules. Sinclair and Nexstar were the most heavily penalised, with fines of $2,652,000 and $182,000 respectively.

The FCC's investigation, which began in September 2022, found that broadcasters aired a commercial for a Hot Wheels-themed toy during a Hot Wheels-themed television show. This was deemed a program-length commercial, violating FCC rules.

The Forfeiture Order includes fines ranging from $20,000 to $2.6 million, with 18 other station groups, besides Sinclair and Nexstar, receiving penalties. These include Apollo, Bally, Berkshire, CBS, Cox, Disney, E.W. Scripps, Entravision, Fox, Gray, Hearst, Hubbard, ION, Ion Media, NPG, and Tegna.

FCC chairwoman Jessica Rosenworcel argued that broadcasters mixed toy commercials with children's programming, violating FCC rules. However, Commissioner Brendan Carr dissented, stating that Sinclair's violation was due to a technical error and the penalty was disproportionate. He also called for reform of the FCC's enforcement practices.
