Customs Authority Raids Frankfurt's Hotel, Construction Sectors Over Labor Law Violations

In September 2023, the Financial Control of Illegal Work (FKS) division of the Customs Authority in Frankfurt am Main conducted inspections in the construction and hotel and catering industries. The aim was to ensure compliance with social security obligations, minimum wage, and to uncover illegal employment, sham self-employment, and performance fraud.

The inspections, involving 40 control officers, eight tax officers, and six police officers, targeted the personnel-intensive hotel and catering industry due to its frequent violations and variable working hours. Mini-jobbers and multiple employment were common, with improperly kept working time records to avoid minimum wage payments. The FKS found 49 cases of suspected violations of the immediate notification requirement and two cases of suspected non-payment of the general minimum wage.

In the construction industry, 12 businesses were inspected, and 75 employees were questioned. This revealed five undocumented foreign employees and 22 cases of suspected non-registration for social security. Cash auditors found deficiencies in cash management in all inspected businesses, leading to warnings and fines.

The Main Customs Office Frankfurt am Main, a certified employer according to the 'berufundfamilie' audit and offering training places, secures social systems and state revenues through risk-oriented inspections. These include random and full inspections, and focus inspections in affected sectors. The FKS conducted nationwide inspections in the hotel and catering industry on September 19, further demonstrating their commitment to enforcing labour laws and protecting workers' rights.
