RWE Faces Climate Change Lawsuit Decision in Hamm Court

The Higher Regional Court of Hamm is set to announce its verdict on May 28, 2025, in a landmark climate change lawsuit against German energy giant RWE. The civil case, initiated in 2015, involves Peruvian farmer and mountain guide, Saúl Luciano Lliuya, who is seeking RWE's financial contribution towards protective measures against potential flood waves from the Palcacocha glacier lake. Lliuya resides in the city of Huaraz, fearing that a glacier collapse or landslide could trigger a flood wave threatening his home.

Lliuya alleges that RWE shares responsibility for this potential danger due to the vast quantities of greenhouse gases emitted by the company's power plants. He is joined in his lawsuit by the Future Sustainability Foundation and environmental organization Germanwatch, while RWE maintains the litigation as legally inadmissible.

In a hearing held in mid-March, two expert witnesses offered their assessments, stating that they do not anticipate a serious impairment to Lliuya's property from flooding or a mudslide within the next 30 years. They attribute a mere one percent likelihood of realistic flooding scenarios occurring. Lliuya's legal and expert team countered that this risk estimation underplays the potential danger.

A bias complaint lodged by Lliuya against one of the expert witnesses was dismissed. The court postponed the initial ruling date from April 14 to May 28 to examine the complaint.

According to Germanwatch, this lawsuit represents a "strategic climate lawsuit," addressing public interest objectives that go beyond individual plaintiff interests. The organization emphasizes that such litigation aims to advance climate protection, safeguard fundamental rights, set legal precedents, compel overdue political action, and raise public awareness.

If the court rules in Lliuya's favor, it would set a significant precedent for future climate change litigation in Germany, marking a crucial step in the recognition of corporate liability for climate change impacts. Climate activists called the outcome a "successful failure," as Lliuya did not secure a victory, but the court's acknowledgment of corporate liability for climate change-related risks established an influential precedent.
