Aegean Sea's Utilization of TAR Challenges Act 4 Decision: Allocated Funds Amount to €69 Million
The Italian water company, Egea Acque, has taken a significant step in the ongoing dispute over the water services in Cuneo, Italy. Yesterday, Egea filed an appeal with the Regional Administrative Court (TAR) of Piedmont against the decision made by ATO 4 in July regarding the liquidation of residual value.
The liquidation of residual value, if completed, will lead to the re-municipalization of water services, a process that was initially voted for in a referendum 14 years ago. The authority, ATO 4, had set a deadline of November 30 for the public consortium Cogesi to complete the liquidation.
According to the same Cuneo ATO, Egea Acque is entitled to a sum of 69 million euros, including 6 million in adjustments, if the liquidation is completed as per the decision by ATO 4. This 6 million euros in adjustments is a part of the total 69 million euros Egea Acque is entitled to.
Mayor of Cuneo, Patrizia Manassero, announced that Egea's appeal concerns the final phase of the liquidation process, awaiting the disbursement of the loan by credit institutions. She expressed hope that this defense could be the final one regarding the liquidation of residual value and the re-municipalization of water services.
Manassero also commented that Cogesi and ATO will defend their position, marking the latest in a series of defenses on the water issue. No statement has been made at this time by the heads of Cogesi regarding the appeal.
If the appeal is successful and the liquidation is halted, it would be a significant development in the long-standing dispute. Egea is asking the administrative judges for a stay that, if granted, would freeze the liquidation procedure. The Egea will appeal to the Regional Administrative Court, and this appeal will be legally decisive once the court issues its ruling after the case is formally submitted and processed.
